General Information

Frequently Asked Questions

Can an arbitral award be challenged in court?

Yes, but only on limited grounds. Under Section 34 of the Arbitration and Conciliation Act, 1996, an application to set aside an award must be made within three months of receiving it, extendable by a further 30 days for sufficient cause. An appeal from the court's decision lies under Section 37.

Can interim relief be obtained before or during an arbitration?

Yes. A court can grant interim measures under Section 9 of the Act — before, during or, in some cases, after the arbitral proceedings — and the arbitral tribunal itself can grant interim measures under Section 17.

What if the other party does not agree on an arbitrator?

Where the parties cannot agree on the appointment of an arbitrator under their agreement, either party can apply to the High Court (or, in international commercial arbitrations, the Supreme Court) under Section 11 of the Act for an appointment.

What is the Delhi International Arbitration Centre (DIAC)?

The DIAC is an arbitral institution functioning under the aegis of the Delhi High Court. It administers arbitrations under its own rules and maintains a panel of arbitrators.
